AB 1358, The Complete Streets Act

Authored by San Francisco Assembly Member Mark Leno, and co-authored by Van Nuys Assembly Member Lloyd Levine, Assembly Bill 1358, the Complete Streets Act, will ensure that the transportation plans of California communities meet the needs of all users of the roadway including pedestrians, bicyclists, users of public transit, motorists, children, the elderly, and the disabled. AARP California joined CBC as co-sponsor of the bill.

AB 1358 requires the legislative body of a city or county, upon revision of the circulation element of their general plan, to identify how the jurisdiction will provide for the routine accommodation of all users of the roadway including motorists, pedestrians, bicyclists, individuals with disabilities, seniors, and users of public transportation. The bill also directs the Office of Planning and Research to amend guidelines for the development of general plan circulation elements so that the building and operation of local transportation facilities safely and conveniently accommodate everyone, regardless of their mode of travel.

Status: The bill was passed by the Legislature, enrolled on Aug. 28, 2008, was signed into law by the governor on Sept. 30, 2008.

SB 375 (Steinberg), Regional planning for greenhouse gas reduction, travel demand models

Authored by Sacramento Senator Darrell Steinberg, this bill seeks to reduce vehicle miles traveled through land use and planning incentives. Key provisions require the larger regional transportation planning agencies to develop more sophisticated transportation planning models, and to use them for the purpose of creating "preferred growth scenarios" in their regional plans that limit greenhouse gas emissions. The bill also provides incentives for local governments to incorporate these preferred growth scenarios into the transportation elements of their general land use plans.

AB 2971, (DeSaulnier), Fair Share for Safety

Authored by Martinez Assembly Member Mark DeSaulnier, this bill would have required the California Department of Transportation (Caltrans) to establish guidance and criteria to ensure that the needs of bicyclists and pedestrians are addressed in the development of its safety programs by January 1, 2010. In developing this guidance and criteria, Caltrans would have had to consider a variety of factors to ensure it takes into account safety problems so severe there is no history of bicycle or pedestrian collisions because few would dare go there on a bike or on foot. It also would have required Caltrans to consult with stakeholders like the CBC when it developed this guidance and criteria.

SB 432 (Lowenthal), Omnibus transportation bill

This bill, authored by Senate Transportation & Housing Committee chair Alan Lowenthal, gathered together a number of minor, non-controversial provisions relating to transportation. Among them is a new statutory definition for the terms "bicycle path," "bike path," and "bicycle path crossing," which helps clarify the right of bicyclists to ride in crosswalks where bike paths cross streets and roads. The definitions were included in the bill in response to several instances where local law enforcement cited bicyclists for doing so.
